Auction Terms and Conditions

Bid must be more than the minimum starting bid and must be more than the previous bid.

Bidding ends on the stipulated date published on the auction page and auction item page.

A buyer’s commission of 15% of the hammer price, unless otherwise specified, shall be payable by the buyer to Art.co.za in respect of the sale of each lot.

A seller’s commission of 20% of the hammer price, unless otherwise specified, shall be payable by the seller to Art.co.za in respect of the sale of each lot.

Items must be paid within 7 business days of the end of the auction or the item will go to the next highest bidder. The buyer must make payment in full before the buyer can collect the purchased item. It must be collected within 7 business days after completion of the payment.

If the buyer is unable to collect, the buyer is responsible for shipping (if you need a shipping quote, email us at auction@art.co.za).

On hand over of the item to the buyer (or their representative), the full risk over that item shall pass to the buyer, who shall henceforth be responsible for any loss of and/or damage to and/or decrease in value of any items purchased at the auction.

Neither Art.co.za nor any of its employees, agents and/or the seller shall be liable, whether directly or indirectly, for any errors, omissions, incorrect and/or inadequate descriptions or defects or lack of authenticity or lack of ownership or genuineness in any goods auctioned and sold which are not caused by the wilful or fraudulent conduct of any such person.

Art.co.za and the seller does not accept any responsibility for any damage by weather damage, insect infestation or other conditions outside its control.

The sale of a item will be confirmed by email sent to the buyer in which the details of the transaction, including the purchase price, buyer commission payable if applicable and any other relevant information is stipulated. The buyer will also be contacted telephonically should it be necessary.

In the event that the highest bid does not meet the reserve, it will remain open for acceptance by the seller within 48 hours after the auction was concluded.

In participating in the auction and bidding for any lots, all bidders confirm that they have not been induced into making any bid or offer by any representative of the seller and/or Art.co.za.

Art.co.za has, during the course of any auction, the sole and absolute discretion, without having to give any reasons therefore, to refuse any bid, withdraw or reoffer items for auction (including after the conclusion of a sale), and cancel any sale if Art.co.za believes that there may be an error or dispute of any nature whatsoever.

Art.co.za undertakes to provide the following services: online marketplace and tools to buy, bid on, inquire about, list, market, offer for sale, and sell artwork and other art related items.

All items are offered for sale and sold directly from the seller to the buyer. Art.co.za may facilitate communication, payment, shipping, or other services between buyers and sellers. However, we are not the agent of any buyer or seller for any purpose. All items will be listed, marketed, offered and sold under the seller’s name, unless otherwise stated. Seller agrees that we may use seller’s name in connection with the listing, marketing, offer and sale of any and all items.
